What is the RUD procedure again?
RUD stands for the Recovery of Undisputed Debts. Since 2016, a bailiff can obtain an enforceable title for an undisputed B2B invoice, without the involvement of a court.
That means no lengthy court proceedings, no lawyer and no waiting for a hearing. But with the same legal force as a court judgment.
A powerful tool. But it only works under certain conditions.
When does your invoice qualify?
Three things determine whether the IOS procedure is an option.
It is a B2B invoice. The procedure only applies between businesses. Invoices issued to private individuals are not eligible.
The invoice is undisputed. As soon as your customer disputes the substance of the invoice, the amount, the service provided or the terms, the IOS procedure stops. A customer who simply does not pay is not disputing the invoice. A customer who says "this isn't correct" is.
The invoice is due and not time-barred. The due date must have passed, and the invoice must not be too old.
Sounds simple. But in practice, the uncertainty often lies in the details: is my customer still solvent? Is that invoice from ten months ago still eligible?
